Terms of Service

These Terms of Service (“Terms”) govern access to and use ofhttps://etyva.com and digital services offered by ETYVA(“ETYVA”, “we”, “us”). By creating an account, signing in, or using the platform, you agree to these Terms and to our Privacy Policy.

If you do not agree, do not use the site or create an account.

1. Acceptance

Using ETYVA constitutes acceptance of these Terms. If you use ETYVA on behalf of a company, you represent that you are authorized to bind that company.

2. Eligibility

You must be of legal age and have capacity to enter into these Terms under applicable law.

3. Accounts and credentials

• Provide accurate information and keep it updated.
• Keep passwords and access credentials confidential.
• You are responsible for activity under your account.
• Notify us promptly of suspected unauthorized use at hola@etyva.com.

We may suspend or terminate accounts that violate these Terms, create security risk, or are used fraudulently or abusively.

4. Permitted use

You may use ETYVA only for lawful purposes and in accordance with these Terms and any product documentation we publish.

5. Prohibited use

You agree not to:

• Access systems, accounts or data without authorization
• Interfere with security, availability or integrity of the service
• Reverse engineer the service except where permitted by mandatory law
• Use ETYVA for unlawful, deceptive or harmful activity
• Upload malware or illegal content
• Impersonate others or deliberately falsify information

6. User and business responsibility

You are responsible for the accuracy of information you submit, including business information you choose to provide. You must have a lawful basis to process any third-party data you upload or analyze through ETYVA.

7. Decision-support tools (including ETYVA Score)

ETYVA may offer technology products such as ETYVA Score that analyze information and help businesses evaluate risk and support commercial decisions.

Such tools provide analysis and decision support. Unless a separate written contract expressly states otherwise:

• ETYVA does not lend money
• ETYVA does not automatically grant credit
• ETYVA does not guarantee solvency, payment or commercial outcomes
• ETYVA does not necessarily replace a credit bureau or regulated data source
• ETYVA does not make the final commercial decision for your business

The final decision remains with the business user. Demo interfaces or mock data on the website are illustrative and must not be treated as real assessments of a specific person or company.

8. Intellectual property

The website, ETYVA brand, logos, text, design, software and related materials are owned by ETYVA or its licensors. You receive only a limited right to use the service as permitted by these Terms.

9. Service availability

We aim to keep the service available, but we do not guarantee uninterrupted access or error-free operation. We may perform maintenance, updates or changes that temporarily affect availability.

10. Third-party services

The service may rely on third parties (for example authentication, hosting or DNS providers). Those services may have their own terms. ETYVA does not fully control third-party operations.

11. Privacy

Personal data is handled as described in thePrivacy Policy. By using the service you also accept that Policy.

12. Suspension and termination

You may stop using the service at any time. You may request account deletion as described athttps://etyva.com/data-deletion.

ETYVA may suspend or terminate access if you breach these Terms, if required by law, or if the service is discontinued.

13. Modifications

We may update these Terms. The current version will be published athttps://etyva.com/terms with an updated date. Continued use after changes become effective constitutes acceptance, except where mandatory law requires express consent.

14. Limitation of liability

To the maximum extent permitted by law, ETYVA is not liable for indirect damages, lost profits, lost data, business interruption, or decisions made based on information from the service.

Nothing in these Terms excludes liability that cannot be limited under applicable law.

15. Governing law

These Terms are governed by the laws of the Republic of Colombia, without prejudice to mandatory consumer or user protections that may apply. Disputes shall be brought before the competent courts of Colombia unless otherwise required by law or agreed in writing.
